Petitioner apprehends his arrest in connection with Baniyapur P.S.Case No. 165 of 2017 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. Allegation against the petitioner is of assault to the cousin father-in-law of the informant by fists and slaps and he fell down and died.

Submission of learned counsel for the petitioner is that there is only allegation of assault by fists and slaps and there is no other accusation and no external injury was found on the person of deceased. Further submission is that co-accused Dayanand Rai has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 15.1.2018 passed in Cr.Misc.No.

Patna High Court Cr.Misc. No.13136 of 2018 (2) dt.05-04-2018 2/2 1831 of 2018.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XI, Saran at Chapra, in connection with Baniyapur P.S.Case No.165 of 2017, G.R.No.4473 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
