ANJANA MISHRA ORAL ORDER 16-08-2017 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in Bahera P.S.Case No.98 of 2015 for the offences under Sections 147, 148, 149, 341, 323, 308 and 504 of the Indian Penal Code. Counsel for the petitioners submits that there is a case and counter case between the parties with injuries inflicted. There is dispute between the parties with injuries and injuries have been inflicted on both sides. Admittedly, there is dispute between the parties who are agnates and the injury report which is Annexure-3 reveals that there was injury by hard and blunt object caused by the said Ram Chandra Sahu though the allegation in the F.I.R. is
Patna High Court Cr.Misc. No.35857 of 2017 (2) dt.16-08-2017 2/2 that they had given a farsa blow. There is history of land dispute between the parties.
Counsel for the informant is also present and submits that there has been land dispute between the parties and the injuries which were caused were such which could have endangered life.
Considering the facts and circumstances of the case that the petitioners have no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of J.M. 1st Class, Benipur, Darbhanga, in Bahera P.S. Case No.98 of 2015 subject to the conditions as laid down under Section 438 (2) of Cr.P.C. (Anjana Mishra, J) AnilKrSinha/- U
