Petitioner is apprehending his arrest in a complaint case instituted for the offence punishable under section 420 of the Indian Penal Code in which cognizance has been taken . It is alleged that the petitioner being own brother of the complainant sold the share of the complainant to Anamika Devi.

It is submitted by the learned counsel for the petitioner that on the basis of the oral partition between the petitioner and the complainant he sold his share and title suit no. 856 of 2013 is pending between the parties.

Considering he nature of accusation in the back ground of the dispute let the above named petitioner be released

Patna High Court Cr.Misc. No.53726 of 2015 (2) dt.26-11-2015 2/2 on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two securities of the like amount each to the satisfaction of Md. Salim, J.M. Ist Class, Bhagalpur in connection with complaint case No. 2484 of 2013, subject to the conditions laid down under section 438(2) of the Cr. P.C.
