The petitioner is apprehending arrest in connection with Gogri P.S. Case No. 419 of 2019, G.R. No. 3578 of 2019 registered for the offence under Sections 406, 420 of the Indian Penal Code.

It is alleged that the petitioner has defalcated the amount to the tune of Rs. 2,42,799/- by way of issuing 364 receipts to the consumers of North Bihar Power Distribution Company Limited.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner is lineman and he has

Patna High Court CR. MISC. No.26794 of 2020(2) dt.11-11-2020 2/2 absolutely no role either to receive the amount or to issue receipt thereof as he is lineman and his job is not connected with receipt of money and issuance of receipt thereof. The petitioner has no criminal antecedent.

Considering the aforesaid submissions and the fact that the petitioner has no criminal antecedent, the Court is inclined to grant privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 419 of 2019, G.R. 3578 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.
