Mr.Tarun Prasad Mandal ====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 19-04-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Pasraha P.S. Case no. 124 of 2017 registered under Sections 366 and 341 of the Indian Penal Code. Petitioners and Suman Kumar @ Sulo are said to have forcibly kidnapped the minor daughter of the informant with intent to perform marriage with her.

It is submitted by learned counsel for the petitioners that the petitioners are quite innocent. They have committed no offence. The victim in her statement recorded under Section 164 Cr.P.C. has candidly denied the occurrence

No.25318 of 2019(2) dt.19-04-2019 2/2 of her kidnapping by anyone rather she has stated that she has suo motu eloped with Suman Kumar @ Sulo and performed marriage with her. Petitioners have been falsely implicated in the case merely because they happen to be brother and parents of the aforesaid Suman Kumar @ Sulo.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Khagaria in connection with Pasraha P.S. Case no. 124 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
