This application for regular bail arises out of Mahila P.S. Case No. 09 of 2020, disclosing offence punishable under Sections 366-A, 323, 341 of the Indian Penal Code and Sections 08/12 of the POCSO Act.

The informant has alleged that her minor daughter had gone to the house of her sister thereafter she did not return. The petitioner is the husband of the informant's sister. It has been alleged against him by the informant that he might have been instrumental for disappearance of the victim. Learned counsel appearing on behalf of the petitioner has straightway drawn my attention to the statement of the victim recorded under Section 164 of the Cr.P.C. to contend that the

Patna High Court CR. MISC. No.26838 of 2020(2) dt.19-10-2020 2/2 allegation against the petitioner is wholly baseless. The petitioner is in custody since 13.03.2020.

Considering the above submission and nature of accusation, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned 1st ADJ, Muzaffarpur cum Special Judge, POCSO, Muzaffarpur, in Mahila (Muzaffarpur) P.S. Case No. 09 of 2020.
