JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 04-08-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the Board.

The petitioner was found drawing electricity by unfair means and as such he was saddled with a bill of Rs.1,64,859/-. The petitioner has filed objection to the same which was rejected by the Assessing Officer.

The petitioner instead of filing statutory appeal has straight away moved this Court in writ jurisdiction. This Court would be loath in entertaining this writ application but as no reason has been given for rejecting the objection of the petitioner, in the interest of justice, I remit the matter to the Assessing Officer for passing a fresh order after considering the objection of the petitioner and giving him personal hearing as he claims that his son (licensee) is mentally retarded. With the aforesaid observations and directions, this writ application stands disposed of.
