The petitioner apprehends his arrest in Pachrukhi (M.H. Nagar) P.S. Case No. 148 of 2016, registered for the offences punishable under Sections 341,323,498 (A), 376/511, 504 and 506 of the I.P.C. and 3⁄4 of Dowry Prohibition Act. The informant made allegation against the petitioner that the petitioner made an attempt to commit rape and torture her for fulfilling the demand of dowry.
Learned counsel for the petitioner submits that the petitioner is brother-in-law of the husband of the informant. The police, after investigation, did not find allegation true under
Patna High Court Cr.Misc. No.18865 of 2017 (3) dt.10-07-2017 2/2 Section 376/511 of the I.P.C., only found the case true u/S 498 (A) of the I.P.C. The other co-accused has already been granted bail in Criminal Miscellaneous Case No. 9400 of 2017 by a bench of this Court.
Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Pachrukhi (M.H. Nagar) P.S. Case No. 148 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
