2. The petitioner seek bail in connection with Makhdumpur (Tehata O.P.) P.S. Case No. 539 of 2023 registered for the offence under Sections 356 and 379 of the Indian Penal Code.

3. It is contended by the learned counsel for the petitioner that on the date of occurrence, the petitioner was in custody. If it is so, the petitioner deserves bail.

4. Accordingly, this application is being disposed of with a direction to the trial court to verify the fact as to whether the petitioner was in custody on the date of occurrence in different case. If it is found that the petitioner
