The petitioner apprehends his arrest in Chakia P.S. Case No. 294 of 2016, arising out of G.R. Case No. 6262 of 2016, registered for the offences punishable under Sections 290,272,273/34 of the Indian Penal Code and 30 (a) of Bihar Prohibition and Excise Act 2016.
5 litres of country made liquor recovered from the house of the petitioner.
Learned counsel for the petitioner submits that the petitioner was not living in the house and a very small quantity i.e. only 5 litres of country made liquor was recovered from the house of the petitioner.
Patna High Court Cr.Misc. No.18911 of 2017 (3) dt.10-07-2017 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced by this order.
