The petitioner apprehends arrest in connection with a case registered for the offences punishable under sections 302, 201/34 of the Indian Penal Code.
The informant police officer got a message that Manisha Kumari was killed by her father and other members of her family only because she was found in company with one Munna Pandit.
Learned counsel for the petitioner submits that on 30.08.2015 itself Biru Ram son of the petitioner gave a petition to the Officer-in-charge of Chapra police station that Munna Pandit kidnapped his sister Manisha Kumari. It is further submitted that the petitioner was not in his house on the date of occurrence. He
Patna High Court Cr.Misc. No.51633 of 2015 (3) dt.21-12-2015 is a District Education Officer and he was present in his office for official duty on 30.08.2015. Annexure-3 series is attached to show the presence of the petitioner in the office. It appears that it is a case of owner killing. The informant got information through message about the death of Manisha Kumari, daughter of the petitioner. Daughter of the petitioner is still traceless.
Considering the facts aforesaid, I am not inclined to grant anticipatory bail to the petitioner in connection with Chapra Mufassil P.S. Case No. 209 of 2015 pending in the court of the learned Chief Judicial Magistrate, Saran at Chapra. This application for anticipatory bail is, accordingly, rejected. The petitioner, if so advised, may surrender and pray for regular bail which will be considered by the court below on its own merit in accordance with law.
