Patna High Court MJC No.4628 of 2014 dt.20-07-2017 2/3 =========================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL JUDGMENT Date: 20-07-2017 Inter alia contending that an order passed by the Writ Court on 30th of January, 2012 in C.W.J.C. No. 1163 of 2010 has not been complied with, this application has been filed for initiating action for contempt.
From the show-cause filed by the University, it is seen that the admitted dues of the petitioner to the tune of Rs. 6,11,900/- along with interest at Rs. 1,11,248/- have been paid to him. However, learned counsel for the petitioner submits that the interest has not been paid, as directed by the Court and calculation of interest has not been done properly.
A perusal of the order passed goes to show that the only direction was to settle the admitted claim and for the delayed payment interest at the rate of 12 per cent per annum has to be made. There is nothing to indicate as to what is the amount of claim and how quantification of the interest is to be undertaken. In view of the above, now merely because it is said that interest has not been properly calculated, I see no reason to initiate any action for contempt instead, in case the petitioner has any grievance with regard to the manner in which his claim has been
Patna High Court MJC No.4628 of 2014 dt.20-07-2017 3/3 considered and decided and it is his case that the amount of interest has not been paid to him, he shall have liberty to assail the same afresh in accordance with law.
