The petitioners seek pre-arrest bail in Chauri P.S. Case No. 70 of 2016 dated 22.07.2016 instituted under Sections 341/323/147/148/149/307/379/504/506 of the Indian Penal Code, 27 of the Arms Act.
The allegation against the petitioners is of assault and use of fire arms.
Learned counsel for the petitioners submits that the parties are agnates and there is case and counter case relating to land dispute. It is submitted that even the injury report /X-ray does not disclose any serious injury.
Having considered the facts and circumstance of
Patna High Court Cr.Misc. No.43920 of 2016 dt.05-10-2016 2/2 the case, the Court is not inclined to enlarge the petitioners on anticipatory bail.
Accordingly, the application stands dismissed. However, in the event the petitioners surrender before the Court below and seek regular bail within one month from today, the same shall be considered on its own merits, in accordance with law, without being prejudiced by the present order.
