The petitioner apprehends his arrest in Ara Nawada P.S. Case No. 340/2016, registered for the offences punishable under Sections 420, 406 and 120B of the Indian Penal Code. The informant alleged that he wanted to take loan for purchasing a house. Dhanjeet Kumar (petitioner) came and assured him to provide loan from a company of Kolkata namely, Dewan Credit Financial Services Pvt. Ltd. The manager of the company is Baloon Rai. The informant applied for loan and also gave cheque of Rs. 5100/- for office expenditure, as demanded by the petitioner, the informant also gave a cancelled cheque bearing no. 142431, but on the cancelled cheque of the informant, Rs. 8,00,000/- was withdrawn and credited in the account of Abhishek Talukdar whose account no. is 128001503715. The informant alleged that the petitioner, Baloon Rai and Abhishek Talukdar

It appears that petitioner persuaded the informant to take loan from the company, as the petitioner went along with the informant for grant of loan and the informant submitted a cheque of Rs. 5,100/-, as office expenditure and a cancelled cheque. Petitioner is ready to make payment of Rs. 1,50,000/- in three equal installments within three months.

Considering the facts aforesaid and the fact that petitioner only persuaded the informant for grant of loan and he is ready to pay Rs. 1,50,000/- in three equal installments within three months, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 340/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. If the petitioner fails to return Rs. 1,50,000/- to the informant within three months, the bail bond of the petitioner shall be cancelled.
