Mr.Ajay Kumar No.2 ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-09-2020 Heard learned counsel for the petitioners and the counsel appearing on behalf of the State.

Petitioners are apprehending arrest in connection with Nauhatta P.S. Case No. 72 of 2019 for the offence under sections 341, 323, 324, 307/34 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioners have no criminal antecedent.

Allegation against these petitioners is that they have assaulted the informant and others by means of lathi. Learned counsel for the petitioners submits that similarly circumstanced co-accused Lalan Yadav lodged a complaint case against the informant and the present case has been lodged as counter blast of the same. He further submits that similarly circumstanced other co-accused have been granted

Patna High Court CR. MISC. No.22520 of 2020(2) dt.04-09-2020 2/2 bail by a coordinate Bench of this Court in Cr. Misc. No. 81629 of 2019 vide order dated 3.2.2020.

Considering the fact that four similarly circumstanced have been granted bail, the Court is inclined to grant anticipatory bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Praduman Kumar, learned Judicial Magistrate-1st Class, Saharsa, in connection with Nauhatta P.S. Case No. 72 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that on release the petitioners shall render their service as volunteer in dedicated Covid-19 hospital for a period of one month. They are required to report to the district Nodal Officer who shall utilize the service of the petitioners appropriately.
