The petitioners apprehend their arrest in connection with Kuttumba P.S. Case no. 39 of 2016, registered under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code. The accusation is that on 24.04.2016 at 06.00 A.M. Sonulal @ Ravi Shankar Lal Sinha came at the door of the informant armed with danda and told him to vacate the land. When the informant made protest then he was assaulted by Sonulal. When brother of the informant, namely, Basant Sharma came to save him then he was also assaulted by Sonulal. When wife of Basant Sharma came to rescue her husband then she was also assaulted by him and Rs. 2000/- was snatched from the pocket of the informant. In the meantime, petitioners Dablu Lal and Sanjay Lal came and caused injury Sunaina Devi and Khusbu Kumar.
Patna High Court Cr.Misc. No.43650 of 2016 (2) dt.18-10-2016 2/2 Learned counsel for the petitioners submits that the occurrence took place due to land dispute in which petitioners have also sustained injuries regarding which Kuttumba P.S. Case no. 40 of 2016, registered under Sections 341, 323, 307, 379, 504, 506 and 325/34 of the Indian Penal Code on the basis of the written report of co-accused Ravi Shankar Sinha. Moreover, injuries as found on the persons of the informant his brother Basant Sharma, Ranju Devi and Khusbu Kumar are simple in nature.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Kuttumba P.S. Case No. 39 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
