The petitioner seeks bail in connection with Mahua P.S. Case No. 326 of 2015 instituted for the offence under Section(s) 392 of the Indian Penal Code. Later on Sections 395/412 of IPC was added.
Learned counsel for petitioner has submitted that petitioner is not named in the written report. No incriminating article has been recovered from possession of this petitioner. No TIP has been held. He further submits that the name of this petitioner has come during investigation in confessional statement of co-accused, namely, Raju Kumar.
Learned counsel for petitioner has further submitted that co-accused, namely, Raju Kumar has already been granted
Patna High Court CR. MISC. No.23437 of 2019(2) dt.11-04-2019 2/2 bail by co-ordinate Bench of this Court by order dated 16.08.2017 passed in Criminal Miscellaneous No. 29172 of 2017.
Petitioner is in custody since 09.09.2015.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Vaishali at Hajipur in connection with Mahua P.S.
