The petitioner seeks bail in Patliputra Police Station Case No. 17 of 2020 registered for the offences punishable under sections 366/364A/379/120B/34 of the Indian Penal Code.

As per the FIR, son of the informant was kidnapped by the petitioner Sanjit Kumar and other four accused persons from the Inustrial area, ION Digital Zone, Patna and then was taken to Motihari by co-accused Ranu, Rahul, Sunny and Prince.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of confessional statement of co-accused Rahul Kumar. Petitioner

Patna High Court CR. MISC. No.26767 of 2020(6) dt.01-02-2021 2/2 is in custody since 14.1.2020.

Learned counsel for the State opposes the prayer for bail and submits that the victim in his section 164 Cr.P.C. statement has alleged that the petitioner and other accused persons kidnapped him and the petitioner was driving the vehicle in which he was shifted after kidnapping. In view of the specific allegation against the petitioner, his prayer for bail is refused.
