This application for grant of anticipatory bail, arises out of Sahajitpur P.S. Case No. 04 of 2017, disclosing offences punishable under Sections 147, 148, 149, 341, 33, 332, 333, 353, 427 and 504 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner has been made accused in this case due to non-fulfilment of demand of Rs. 10,000/- made by the informant, who is said to be a SubInspection of Police, for which, an F.I.R. being Sahajitpur P.S. Case No. 05 of 2017 was also lodged against the informant. No

Patna High Court Cr.Misc. No.33278 of 2017 (2) dt.20-07-2017 specific case is made against the petitioner. Moreover, co-accused, Mantu Ojha and Navin Ojha, having more or less similar allegation, have been granted anticipatory bail vide Cr. Misc. No. 28596 of 2017 by a co-ordinate Bench of this Court. Hence the petitioner deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-8th, Saran at Chapra in connection with Sahajitpur Police Station Case No. 04 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
