The petitioners apprehend their arrest in connection with Kajraili P.S. Case no. 24 of 2017, registered under Section 364/34 of the Indian Penal Code. The accusation is that in the evening of 05.06.2017 Soni Devi, sister-in-law of the informant was kidnapped by nine accused persons named in the F.I.R. including the petitioners.
Learned counsel for the petitioners submits that Soni Devi is grand-daughter of petitioner No.1, who was married with elder brother of the informant and she was being tortured due to that reasons nephew of petitioner No.1 lodged
Patna High Court Cr.Misc. No.11083 of 2018(2) dt.26-02-2018 2/2 Kajraili P.S. Case No. 40 of 2016 under Section 366(A)/34 of the Indian Penal Code against the brother of the informant and his family members regarding the kidnapping for the purpose of marriage due to that reasons, the informant has lodged the present case only to put undue pressure on 13.06.2017 regarding the alleged occurrence of 05.06.2017 after eight days.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-XIV, Bhagalpur in connection with Kajraili P.S. Case No. 24 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
