JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks pre-arrest bail in connection with Tajpur P. S. Case No. 257 of 2015 registered under Sections 341, 323, 324, 325, 326, 307/34 of the Indian Penal Code and 27 of the Arms Act.
It is contended that the petitioner is alleged to have assaulted with sword on the neck of the informant, but the injury report would reflect that the said injury was simple in nature. Be that as it may, regard being had to the serious nature of allegation leveled against the petitioner, I am not inclined to grant him anticipatory bail. Accordingly, the application for anticipatory bail is rejected.
In case, the petitioner surrenders and seeks bail, the
Patna High Court Cr.Misc. No.51821 of 2015 (2) dt.09-11-2015 2/2 same shall be considered on its own merit without being prejudiced in any manner by this order.
