Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State in virtual Court.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The FIR of the occurrence of dacoity is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused-Santosh.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and Santosh has simply stated against the petitioner that Santosh and others looted away the vehicle loaded with onion and thereafter he phoned to

Therefore, there is no direct evidence against the petitioner that petitioner is involved in the occurrence of robbery. Considering the submission aforesaid and no material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Mohania P.S.Case No.

530 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case and also the petitioner shall not leave the country without permission of the learned Trial Court , failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
