Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Civil Line P.S. Case No. 200 of 2022 registered on 01.05.2022 lodged under Sections 392 of the I.P.C.

As per the prosecution case, the F.I.R. has been lodged against four named accused persons, other than the petitioner, who in connivance with each other alleged to have committed the robbery and fled from the place of occurrence but upon chase those accused persons were caught. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 21.07.2022 having six criminal cases pending against him, in which he is on bail in all

Patna High Court CR. MISC. No.29297 of 2023(2) dt.08-06-2023 2/2 the six cases. Counsel submits that from the content of the F.I.R. it is crystal clear that only four persons have committed the said crime and their names have also figured in the column 7 of the F.I.R.

Counsel for the petitioner submits that there is criminal antecedent of the petitioner due to which the police has hatched the conspiracy against him and figured his name in this case.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Gaya in connection with Civil Line P.S. Case No. 200 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
