JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This is an application for grant of anticipatory bail in connection with Revilganj P.S. Case No.320 of 2018 disclosing offences under Sections 364, 120(B)/34 of the Indian Penal Code/ Allegation as per F.I.R. against the petitioner is that on 11.10.2018 Bimlawati Devi, her son Jitendra Prasad @ Sethi was to be released from jail custody. Jitendra Prasad told his brother that he will come later on and thereafter, Jitendra Prasad could not reach at the house and his motorcycle was found lying near the brick-klin and statement of one accused Rizwan Ahmad was arrested by the police and his statement is also part of the F.I.R.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.22669 of 2019(3) dt.14-05-2019 2/2 that except confessional statement of the accused there is nothing against the petitioner and he has falsely been implicated in this case.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above and the case is under investigation, I am not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
