Petitioner seeks regular bail in connection with Chandardeep P.S. Case No. 113 of 2020 registered for the offence under Sections 341 , 307, 34 of the IPC and Section 27 of the Arms Act.
Petitioner has allegedly fired upon the informant which hit near his left thigh and the firing made by other accused person hit near the stomach of the informant. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to previous enmity between the parties and an FIR was earlier lodged by the co-accused (agnate of the petitioner) Chunarik Yadav against the informant of the present case. Patna High Court CR. MISC. No.35291 of 2021(3) dt.21-03-2022 2/2 submits that petitioner is in custody since 7th February, 2021, charge sheet has already been submitted, there is no likelihood that petitioner will abscond or tamper with the evidence if released on bail.
Regard being had to the submissions made by the parties, taking into consideration the materials available on record, previous enmity between the parties, the fact that petitioner is in custody since 7-2-2021, charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence, as such, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- ( twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Jamui in connection with Chandardeep P.S.
