JUSTICE SUDHIR SINGH ORAL ORDER 03-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 304 (B), 323 and 506 of the Indian Penal Code.
The prosecution case, in short, is that the informant
solemnized marriage of his daughter with co-accused Babloo Thakur alias Sanjeev Thakur in the year 2007 and she went to her Sasural. After 5-6 months all the accused persons including the petitioners asked her to demand a sum of Rs.2,00,000/- from her parents and on account of non-fulfilment, they used to torture her and ultimately she was killed.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioner No.1 in Cr. Misc. No.48277/2015 is the mother-in-law of the deceased and petitioner No.2 is the Dewar of the deceased. Petitioner in Cr. Misc. No.51315/2015 is the cousin sister-in-law of the deceased. The petitioners have falsely been implicated and they are separate in mess and property from the husband of the deceased. The police has submitted a final form against the petitioners. On behalf of the State, it is submitted that the petitioners are named in the first information report.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bettiah (West Champaran) in connection with
