JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 The petitioner seeks regular bail in connection with Chautarwa P.S. Case No. 217 of 2018, registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Allegation as per F.I.R. is that father of informant had gone to the market for preparation of his Aadhar Card and also to purchase some articles but he did not return and later on his dead body was found lying near a lonely place. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R., his name has surfaced during course of investigation after 13 days on the statement of wife of the deceased and others, as they suspected the hands of the

Patna High Court CR. MISC. No.23874 of 2019(3) dt.21-05-2019 2/2 petitioner, as he was seen going along with the deceased and except that there is nothing against the petitioner and he has been in judicial custody since 21.02.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -1st, Bagaha, District - West Champaran, in connection with Chautarwa P.S. Case No. 217 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
