2. In this case, the petitioner is seeking regular bail in connection with Budha Colony P.S. Case No. 77 of 2025, registered for the offences punishable under Sections 316(2), 318(4), 303(2) & 317(2) of BNS 2023.

3. As per allegation, the petitioner and co-accused Ajeet Kumar were caught red-handed by the police while attempting to withdraw money using stolen ATM cards. A touchscreen mobile phone was also recovered from the possession of the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Allegedly, he is involved in withdrawal of the money from ATM after changing the ATM cards but no ATM card has been recovered from his possession. Only a touch screen mobile set was recovered from his possession and co-accused Ajit Kumar, from whose possession, two ATM cards were recovered, has been granted bail. He has also submitted that the case of the petitioner is on better footing than that of co-accused Ajit Kumar.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM-XIV, Patna in connection with Budha Colony P.S. Case No. 77 of 2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
