ANJANA PRAKASH ORAL JUDGMENT Date: 21-01-2016 The Petitioner seeks revision of the judgment of conviction dated 30.05.2006 passed by the Additional Sessions Judge, F.T.C.-V, Bhojpur at Ara in Criminal Appeal No. 34 of 1993, by which he has affirmed the judgment dated 27.05.1993 passed by the Judicial Magistrate, 2nd Class, Ara in Excise Case No. 74 of 1989 (Tr. No. 43 of 1993) by which he has convicted the Petitioner under Section 47A Excise Act and sentenced him to undergo R.I. for ten months and a fine of Rs. 700/-.

On perusal of the impugned judgment of conviction, I find no in infirmity in the same.

However, considering the period of custody and the date of occurrence, the sentence is reduced to the period

Patna High Court CR. REV. No.752 of 2006 dt.21-01-2016 already undergone by the Petitioner.

With the aforesaid observations, the Application stands dismissed.
