JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 13-07-2017 The writ application is disposed of with a direction to the Vice Chancellor of the University to re-examine the case of the petitioner for payment of his pension on the basis of the pay scale, which is applicable to a Professional Junior, the post from which the petitioner has retired.
The counter affidavit of the University to say the least is absurd. If the petitioner did not continue on the post on which he was appointed and the University itself has decided to post him as a Professional Junior, the Court fails to understand as to why he will not get the benefit of the pay scale, which is available to a Professional Junior. Such a decision must be taken within a period of eight weeks from the date of production of a copy of this
Patna High Court CWJC No.15241 of 2014 (4) dt.13-07-2017 2/2 order or else the Vice Chancellor will be personally held liable for non- compliance.
