NILU AGRAWAL ORAL ORDER 22-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. Petitioner is languishing in judicial custody since 14.02.2019 in connection with Salaiya P.S. Case No. 09 of 2019 for offences punishable under Section 414 of the Indian Penal Code.

The prosecution case as lodged by the police personnel is that the on secret information that some accused person have concealed stolen motor pump set in the house, a raid was conducted and from the house of the petitioner, two motor pump sets were recovered. Accordingly, a seizure list was prepared.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and

Patna High Court CR. MISC. No.25648 of 2019(2) dt.22-04-2019 2/2 nothing has been recovered from his conscious possession and that one of the co-accused on similar allegation has been granted the privilege of bail by this Court in Cr. Misc. No. 22971 of 2019 dated 15.04.2019.

Considering the nature of allegations and that petitioner does not bear any criminal antecedent as stated in para-3 of the present application, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Salaiya P.S. Case No. 09 of 2019, subject to the condition that one of the bailors would be close relative of the petitioner having sufficient immovable properties, who will file an affidavit stating his relationship with the petitioner.
