The matter at issue is the payment of alleged contractual dues of the petitioner. In the whole writ petition, no document/ order has been brought on record by the petitioner to show that it was issued by the competent authority including the respondents for putting up the hoarding. Entire claim is based on oral order. In the counter-affidavit filed on behalf of the respondent no.3, the entire claim raised on behalf of the petitioner has been disputed. Aforesaid counter-affidavit was filed way back on 24.01.2011, but till date no rejoinder affidavit has been filed on behalf of the petitioner controverting the averments made in the aforesaid counter-affidavit.

In above view of the matter, relief sought for on behalf of the petitioner cannot be granted in the present proceeding under Article 226 of the Constitution of India. The writ petition is completely misconceived and is, accordingly, dismissed. (Birendra Prasad Verma, J) BTiwary/- U
