The petitioner seeks bail in Sonepur Rail P.S. Case No. 91 of 2018, instituted for the offence under Section(s) 08, 20 and 22 of Narcotic Drugs and Psychotropic Substance Act.
It is alleged in the written report that informant on getting information apprehended petitioner along with other female passengers while boarding in Coach No.S-6 of Purbiya Express. On search of bags of three persons, total 38 kg. of Ganja has been recovered.
Counsel for the petitioner submits that petitioner is in custody since 27.7.2018.
Report was called for from the court below which
Patna High Court CR. MISC. No.22636 of 2019(5) dt.11-07-2019 2/2 has been received. From the report it appears that evidence has already started. Out of five witnesses, one witness been examined.
Therefore, this Court is not inclined to grant bail to the petitioner at this stage.
Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial and make efforts to conclude the trial as early as possible preferably within a period of six months by giving short adjournments in the case.
