The petitioner is apprehending his arrest in connection with Darbhanga Mahila P.S.Case no.76 of 2017, registered for offences punishable under Sections 328, 506, 509 and 354A/34 of the IPC read with Section 9/12 of POSCO Act.
Allegation against the petitioner is of misbehaving with the minor girl of the informant.
Submission of the learned counsel for the petitioner is that no such occurrence has taken place and he has been falsely implicated in this case.
Heard learned A.P.P. also.
Having heard both sides, in view of allegation, as stated above, and the age of the girl, this is not a case of grant of
Patna High Court Cr.Misc. No.3598 of 2018 (2) dt.01-02-2018 2/2 anticipatory bail rather let the petitioner surrender before the court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
With the aforesaid observation, this application is dismissed.
