The petitioner apprehends arrest in Sahiyara P.S. Case No. 97 of 2017 instituted for the offence under Sections 304(B),34 of the IPC.

The petitioner is the husband of the deceased. There is specific allegation in the written report against the petitioner that after marriage the petitioner and his family members used to torture for demand of Rs. 50,000/-. It is alleged that on 11.06.2017, the informant got information that his sister was taken to Sitamarhi for treatment, but when he reached to Sadar Hospital, Sitamarhi, he did not find his sister Shobha Devi. Thereafter, he learnt that his sister was burnt and taken to private clinic. He reached there and saw his sister lying alone

Patna High Court Cr.Misc. No.7445 of 2018(3) dt.20-03-2018 2/2 and she was completely burnt. He took her to Sadar Hospital, Sitamarhi, where doctor declared her dead.

Learned counsel for the petitioner has submitted that a compromise petition has been filed in the court below by the informant.

There is direct allegation against the petitioner. Therefore, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law and disposed off preferably on the same day, without being prejudiced by this order.
