Petitioner seeks bail in Barhat P.S. Case No.28 of 2018 instituted for the offence under Section(s) 302 and other allied sections of Indian Penal Code, Section 3⁄4 of the Prevention of Damage of Public Property Act, Section 27 of the Arms Act and Sections 10, 13, 16, 18, 20, 21 of the UAP Act. Counsel for the petitioner submits that name of the petitioner has been mentioned in the written report merely on suspicion.

It is alleged in the written report that one dead body of Madan Kora was lying in the Common room of the school and another dead body of Pramod Kora was lying in wheat field towards northern side of the school. It is alleged that younger

Patna High Court CR. MISC. No.22633 of 2019(2) dt.09-04-2019 2/2 brother of the deceased, namely, Ranjit Kora, informed the police that he learnt from sources the name of this petitioner and sixty other persons, as named in the written report, involved in the commission of offence.

As such, mere suspicion has been raised against the petitioner in the written report.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jamui, in connection with Barhat P.S. Case No.28 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
