The petitioner is apprehending his arrest in Thakurganj P.S.Case No.82/16 for the offence under Sections 302, 201,34 of the Indian Penal Code.
The petitioner is the wife of the deceased who is said to have been found dead hanging with a rope from a tree. It is stated in the F.I.R. itself that this petitioner had made query from the informant as to whether the deceased had reached his home. There is no specific allegation against the petitioner regarding any difference between the petitioner and her husband, deceased and the only allegation is that she frequently used to go to her parental home after her marriage.
Considering the entire facts and circumstances of the
Patna High Court Cr.Misc. No.35664 of 2017 (2) dt.16-08-2017 2/2 case and the fact that the petitioner is not named in the F.I.R., let the petitioner, above named in the event of her arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Kishanganj, in Thakurganj P.S. Case No.82/16, subject to the conditions as laid down under Section 438(2) Cr.P.C.
