====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 26-11-2020 Heard the parties through the virtual court proceeding. The petitioner apprehends his arrest in connection with Kanti P.S. Case No. 62 of 2020 registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

As per F.I.R., this is a case of theft by some unknown person in the shop of informant Anil Kumar situated at Sadatpur behind the Narayan Patrol Pump. The stolen goods were recovered by the police and three persons were arrested. One of the co-accused in his confessional statement stated about the involvement of the present petitioner in the aforesaid offence. Learned counsel fo the petitioner submits that the

He further submits that the petitioner is not named in the F.I.R. and no stolen article was recovered from the house of the petitioner. Except the confessional statement, nothing against the petitioner. He further submits that the petitioner has got no any criminal antecedent mentioned in paragraph-3 of the bail petition.

Learned A.P.P. for the State has opposed the prayer for bail.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West, Muzaffarpur in connection with Kanti P.S. Case No. 62 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
