Two petitioners, who are named as accused in K.Nagar (Sri Nagar) P.S. Case No.16/2016 registered for the offence under Sections 379 and 411 of the Indian Penal Code, have prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that the allegation made in the F.I.R. appears to be not probable. He submits that from the F.I.R. itself, it is evident that at 12.30 A.M., some one allegedly had informed the informant that they had seen the petitioner and others fleeing away with buffalo
Patna High Court Cr.Misc. No.38156 of 2016 (2) dt.14-09-2016 2/2 of the informant. He submits that it is not probable. However, after noticing the F.I.R, the Court is satisfied that it is not a case for grant of anticipatory bail. The petition stands dismissed.
