JUSTICE ANIL KUMAR SINHA ORAL ORDER 12-06-2025 Mr. Dhirendra Kumar Sinha, learned counsel for the petitioners submits that during pendency of this application the petitioner no. 1 has been arrested, accordingly, this application in respect of the petitioner no. 1 is dismissed as withdrawn.

2. Insofar as petitioner no. 2 is concerned, this application for grant of anticipatory bail, arises out of Karpi P.S. Case No. 274 of 2024 for the offences under Sections 191(2), 190, 115(2), 109, 132, 304 of B.N.S. Act, 2023.

3. As per the FIR, on 29.11.2024 during PAX election some unknown person arrived and assaulted the

No.24084 of 2025(3) dt.12-06-2025 2/3 informant due to which he sustained injury on his shoulder, head, eye etc. The mobile of the informant was also snatched by the unknown persons, the informant came to know about the names of the accused persons through the local people.

4. Learned counsel for the petitioner no. 2 submits that he has falsely been implicated in this case due to political rivalry at the behest of local people and police authority. The complaint case has been lodged by the side of the petitioner bearing Complaint Case No. 336 of 2024 against police officer in which the cognizance has been taken against them. The petitioner is a student of K.K University and pursuing diploma in Civil Engineering. Referring to the supplementary affidavit, learned counsel submits that injury caused to the informant is simple in nature as annexed at Annexure-P/6 to the supplementary affidavit.

5. Having regard to the submissions made by the parties and taking into consideration the nature of allegation and the fact that the injury sustained by the informant is simple in nature, I am inclined to grant the privilege of anticipatory bail to the petitioner no. 2.

6. This bail application in respect of the petitioner no. 2 is, accordingly, allowed.

7. Let the petitioner no. 2, above named, in the event of his arrest or surrender before the Court below within four weeks from today, be released on bail furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties each to the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal, in connection with Karpi P.S. Case NO. 274 of 2024. Subject to the condition laid down under Section 482(2) of the B.N.S.S. (Anil Kumar Sinha, J) Raj Ranjan/- U T
