2. The accused/petitioners are named in the F.I.R. and apprehended their arrest in connection with Pipariya P.S. Case No. 41 of 2024 registered for the offences punishable under Sections 341, 323, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The allegation against the petitioners is to open fire upon informant along with other co-accused
Patna High Court CR. MISC. No.23924 of 2025(2) dt.07-05-2025 2/3 persons.
4. Learned counsel appearing on behalf of the petitioners submitted that all above named petitioners are full brother and they are in enimical terms with informant. It is pointed out that petitioner no. 1 is the informant of Pipariya P.S. Case No. 144 of 2023. It is pointed that when informant was released on anticipatory bail, he assaulted mother of petitioners namely Sundari Devi causing grievous injuries for which Pipariya P.S. Case No. 42 of 2024 was lodged by mother of petitioners and to settle the score present false case was lodged alleging that petitioners open fired with intention to kill him. It is submitted that present FIR was lodged on the same very day, but no cartridge shell was recovered from the place of occurrence. It is admittedly submitted that bullet did not hit informant causing any firearm injury. While concluding the argument it is submitted that petitioners are men of clean antecedent.
5. Learned APP appearing on behalf of the State, opposes the prayer for bail.
6. In view of aforesaid facts and circumstances and
Patna High Court CR. MISC. No.23924 of 2025(2) dt.07-05-2025 3/3 by taking note of nature of accusations, where admittedly no bullet injury was found upon the informant, accordingly all above named petitioners, in the event of their arrest or surrender before the learned Trial Court within a period of four weeks, are directed to be released on bail, furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Lakhisarai/concerned Trial Court where the case is pending in connection with Pipariya P.S. Case No. 41 of 2024 subject to the conditions as laid down under Section 482(2) of the BNSS.
