JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 22.11.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with a case registered under sections 379, 411, 420, 467, 468, 471 and 120B/34 of the Indian Penal Code.

Petitioner happens to be owner of the truck and it is alleged that his truck loaded with coal was found overload. Learned counsel for the petitioner submits that the document goes to show that truck loaded with coal was found near about 40.84 M.T when weight of the aforesaid truck was done and the aforesaid fact is admitted from perusal of the documents annexed with FIR itself.

Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within six weeks from the date of receipt of this order

Patna High Court Cr.Misc. No.40195 of 2016 (3) dt.22-11-2016 to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Banka P.S.
