The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.

The accusation is of abducting the minor daughter of the informant.

It is submitted by learned counsel for the petitioners that in 164 Cr.P.C. the statement the victim got her age recorded as 19 years when the court has assessed as 18 years where she has stated that she of her own married with Tauquir. The petitioners happen to be the mother and brother of Tauquir,

Patna High Court Cr.Misc. No.53183 of 2015 (2) dt.24-11-2015 2/2 hence, they have been roped in the present case. Moreover, Tauquir has been granted anticipatory bail vide Cr. Misc. No. 51846 of 2015 by a co-ordinate Bench of this Court. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S. Case No. 265 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
