JUSTICE SANJAY PRIYA ORAL ORDER 17-07-2017 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor for the State.

The petitioner apprehends his arrest in G.O. Excise P.S. Case No. 619 of 2015 instituted for the offence under Sections47(a)(f) of the Bihar Excise Act. As per written report, 13 litres of country-made liquor and 40 kg. of Jawa Mahua were recovered from the house of the petitioner. The petitioner managed to run away on seeing the Excise Authority.

The seizure list has been prepared which is enclosed. The aforesaid illicit liquor and Jawa Mahua were recovered from the house of the petitioner.

Therefore, this court is not inclined to grant anticipatory

Patna High Court Cr.Misc. No.32790 of 2017 (2) dt.17-07-2017 2/2 bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected.

The petitioner is directed to surrender in the court below and seek regular bail, which will be considered by the court below on its own merit without being prejudiced by this order in accordance with law.
