JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-08-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner apprehends his arrest in C2A Case No. 225 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 189 litres of foreign liquor has been recovered from bamboo clump situated behind the house of one Kailash Rai. It is submitted that nothing has been recovered from conscious possession of this petitioner and he has got no concern with the seized liquor or Kailash Rai. Petitioner claims clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed in the event of his arrest/surrender before the court below
Patna High Court CR. MISC. No.25831 of 2022(2) dt.05-08-2022 2/2 within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. IInd-cum-Additional District & Sessions Judge, Vaishali at Hajipur in connection with C2A Case No. 225 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
