JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379, 411, 120B of the Indian Penal Code, section 4/44 of the Bihar Minor Mineral Concession Rules, 1972 and sections 33, 41, 42, 51, 52 of the Indian Forest Act.

The prosecution case is that two trucks loaded with stone chips were intercepted when it is alleged that the chips were being carried illegally.

It is submitted by learned counsel for the petitioner that the transportation was made by owner of the stone chips and the petitioner is owner of the vehicle. It is further submitted that the vehicle was used as a public carrier by the driver. A statement has been made in paragraph 3 of the petition that the petitioner has no

Considering the fact that the petitioner was not present in the vehicle when chips were being carried, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Bikramganj in connection with Bikramganj P.S. Case No.81 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
