1. Heard learned counsel for the petitioner and the State.

2. The petitioner seeks bail in Sessions Trial No. 105 of 2019 arising out of Buxar (T) P.S. Case No. 261 of 2018 registered for the offence under Sections- 302, 307, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner was the assailant.

4. A report was called for from the trial court.

5. It has been reported that the trial is likely to be concluded within a period of four months.

6. On behalf of the informant, it has been submitted

7. Considering the nature of accusation and stage of the case, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected.

8. The trial court is directed to take all necessary steps to expedite the trial and conclude the same as early as possible, preferably within a period of four months from the date of receipt/production of copy of this order.

9. The District Magistrate and the Superintendent of Police, Buxar are directed to produce the prosecution witnesses on the date fixed by the trial court so that the trial could be concluded within the stipulated period of four months.

10. Let a copy of this order be communicated to the District Magistrate and the Superintendent of Police, Buxar for needful.
