JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-08-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner apprehends her arrest in Janta Bazar P.S. Case No. 05 of 2022, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 10 litres of country made liquor has been recovered behind the house of this petitioner.

It is submitted that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from open place. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be

No.25830 of 2022(2) dt.05-08-2022 2/2 enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court II, Saran at Chapra in connection with Janta Bazar P.S. Case No. 05 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
