The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code. The accusation is of killing the son of the informant by the accused persons including the petitioner. It is submitted by learned counsel for the petitioner that there is no eye witness to the occurrence and only on the basis of suspicion, this false case has been registered against the petitioner. The witnesses in their evidence have also stated the enmity between the informant and petitioner's side. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the fact that for the alleged occurrence of 21.10.2010, the impugned order was passed on 10.05.2011 by the learned Sessions Judge, Bhagalpur which order was challenged by filing the present criminal miscellaneous petition on 15.06.2021, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
