02. Permission is accorded.

03. Heard learned counsel for the petitioner and learned APP for the State.

04. In the present case, the petitioner seeks bail in connection with Marhowrah P.S. Case No. 704 of 2025 registered for the alleged offences under Sections 310(4), 310(5) of BNS and Sections 25(1-b)a/26/35 of the Arms Act.

05. As per prosecution case, secret information was received about assembly of some miscreants with firearms and a raid was conducted at the identified place and this petitioner along with other co-accused persons were apprehended. From the possession of this petitioner, recovery of one foldable knife

Subsequently, police came to know that the petitioner and other co-accused persons had been making plan for looting some ATM and they were also involved in abduction of a person for ransom and ransom of Rs.Two lakhs was paid by the family members of the abducted person, who was recovered on the disclosure of co-accused Pramod Kumar Mahto.

06. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of the petitioner and the allegation of recovery of foldable knife and a mobile phone is false and concocted. The mobile phone recovered from the petitioner belongs to him. Learned counsel further submits that the petitioner is in custody since 21.10.2025 and charge sheet has been submitted. The petitioner has got clean antecedent.

07. Learned APP opposes the submission made on behalf of the petitioner. Learned APP submits that from the contents of the FIR it appears that the petitioner is part of the gang which is involved in commission of some serious offence.

08. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the

No.25554 of 2026(2) dt.17-04-2026 3/3 non-specific nature of allegation against the petitioner and also considering the period of custody of the petitioner, his clean antecedent and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran/concerned Court in connection with Marhowrah P.S. Case No. 704 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
